Terms and Conditions
ScotPulse is a trading name of STV Central Limited, a company registered in Scotland with company number SC172149 and having its registered office at Pacific Quay, Glasgow, G51 1PQ (hereinafter referred to as “ScotPulse”, “we”, “us”). Please read these Terms and Conditions to make sure that you understand how the ScotPulse panel works, conditions of ScotPulse panel membership and the terms and conditions of entry into our free monthly prize draws.
ABOUT SCOTPULSE
ScotPulse is Scotland’s first online research panel dedicated to voicing peoples’ opinions on what really matters to them. Once you have successfully registered to be a member of the ScotPulse panel via the registration survey on the ScotPulse website, you will be invited by way of email to take part in various research surveys from time to time. The surveys may ask questions on a range of topics including television shows, topical issues, new products and much more. We will try and restrict the number of surveys you are invited to complete to a maximum of one per week.
ACCEPTANCE OF TERMS AND CONDITIONS
Your membership of the ScotPulse panel and your participation in any ScotPulse activities described below (including your participation in our free monthly prize draw upon completion of at least one survey in a month), is governed by these Terms and Conditions. By ticking “I have read and accept the Terms and Conditions” during the registration process to become a member of the ScotPulse panel or by participating in any survey or ScotPulse activity, you agree to be bound by these Terms and Conditions. Should you not wish to accept these Terms and Conditions, you must leave the ScotPulse website immediately and cease your membership of the ScotPulse panel.
ScotPulse reserves the right at any time and from time to time, to modify or amend these Terms and Conditions or any part of them. We will inform you in advance of any changes before they become effective. Your continued use of the ScotPulse website or continued participation in the ScotPulse panel once the changes take effect shall indicate your continued agreement to be bound by the modified Terms and Conditions. We reserve the right to seek compensation from you for any loss or damage we may suffer as a direct consequence of any breach by you of these Terms and Conditions.
SCOTPULSE PANEL MEMBERSHIP
To become a member of the ScotPulse panel you must: • be at least 16 years of age; • be habitually resident in Scotland; and • complete the registration process at www.scotpulse.com. Once you have successfully completed the registration process, we will send you an email that confirms you are a member of the ScotPulse panel.
HOW IT WORKS
As a member of the ScotPulse panel you will have the opportunity to share with us your views on a wide range of topics, services and products. You will be invited to participate in regular online surveys, most of which will take no longer than 10 minutes to complete. Where possible, we will tailor the surveys that you receive to your interests expressed in your registration survey. ScotPulse will further tailor the surveys for panel members who are 16-17 years old (on the basis of date of birth given to us in the registration survey) by excluding content and topics that could be unsuitable for children of that age, for example alcohol products, gambling services, etc.
By clicking on the link in an email invitation to take part in a survey, you will be re-directed to the first page of the survey. You can begin the survey straightaway. You do not need to log in to your ScotPulse account to complete the survey. The unique link in your email invitation will allow us to identify that you have completed the survey and its completion will be logged in your ScotPulse account. Your record of completed surveys can be accessed by going to Completed Surveys in your ScotPulse account.
ScotPulse provides market research services to our clients which involves the production of anonymised reports based on survey responses collected from you and other ScotPulse survey participants. We provide those anonymised reports to our clients. At no time will we pass on any information that will enable our client to identify you unless we have your explicit consent.
OPTING OUT AND ENDING YOUR SCOTPULSE PANEL MEMBERSHIP
Your participation in any survey is voluntary. If you do not wish to take part in a particular survey, you can ignore the email from ScotPulse inviting you to take part in it or you can exit the survey at any time after choosing to take part in it. If you no longer wish to receive invitations to take part in ScotPulse surveys, you can end your membership of the ScotPulse panel at any time by going to Unsubscribe in your ScotPulse account or emailing us directly at unsubscribe@scotpulse.com and telling us. When you unsubscribe, you will no longer receive emails from ScotPulse and we will delete all data which directly identifies you in accordance with our Privacy Policy. You agree that ScotPulse, in its sole discretion, may suspend your membership of the ScotPulse panel, your participation in any ScotPulse activity or your access to the ScotPulse website for any reason, including in circumstances where your email address no longer receives emails or if we believe that you have breached, or acted inconsistently with the spirit of, these Terms and Conditions.
PRIZE DRAW TERMS AND CONDITIONS
If you complete at least one survey in a month, we will automatically enter you into our free monthly prize draw for that month. We may also run special one-off prize draws from time to time, and the terms and conditions of those special one-off prize draws will be provided to you at the time of entry. The terms and conditions of the free monthly prize draw are as follows, unless we notify you otherwise: • a prize draw will take place monthly; • panel members who complete at least one survey in a month will be automatically entered into the prize draw for that month; • only one entry per email address will be made; • the winner will be chosen at random from all eligible entrants; • the winner will be notified by email and delivery of the prize will be within 8 weeks of the confirmation email; • the prize may be a cash prize or vouchers, to be determined at our sole discretion, with details of the prize posted on the ScotPulse website; • there are no alternative prizes and, where the prize is not a cash prize, there are no cash substitutes; • the first name of the winner(s) and their town, alongside the details of the prize that they have won, will be posted on the ScotPulse website and in other communications unless that person has told us not to do so.
USER NAME AND PASSWORD
During the registration process, you will be required to provide your email address and a password to create your ScotPulse account. Your email address will act as your user name to log in to your ScotPulse account. You should keep your password safe and not disclose it to anyone. Should you become aware that your password has been compromised, you should immediately change your password using either the “Forgot your password?” link available on the log in page of the ScotPulse website or the Change Your Password tab if you are logged in to your ScotPulse account. LINKS TO OTHER SITES AND SOCIAL NETWORKING
As part of a survey, you may have the option of viewing content on a third party website accessible via a link. In addition, ScotPulse has its own pages on selected social networking sites that you can subscribe to or follow to keep up to date with the latest ScotPulse activities and news, and to share your views and opinions.
Please note that these Terms and Conditions do not apply to any third party websites, including social networking sites. These third party websites are not owned or operated by ScotPulse. We do not control them or have any responsibility for them or their content. Third party websites have their own terms of use, privacy and other policies which you must read and satisfy yourself with. Disclosure of personal, private and confidential material on a public forum shall become public information and such disclosure is at your own risk.
CONFIDENTIALITY AND PROTECTING YOUR PERSONAL DATA
The personal information you provide when completing the registration process or answering a survey is confidential. The information you provide allows us to produce anonymous research results for our clients. Your information may be combined with data from other sources and it may also be combined with data about other ScotPulse survey participants to create aggregated insights. The research results that we provide to our clients will not reveal your identity except where you have given us your explicit consent (for example, where you have consented to take part in further research with our clients). LAWS AND GUIDELINES
ScotPulse follows the requirements of the following laws, statutes and codes:
- all applicable data protection and privacy laws in force from time to time in the UK, including without limitation: (i) the UK GDPR (i.e. the EU GDPR as it forms part of UK law); (ii) the Data Protection Act 2018 (and regulations made thereunder); and (iii) the Privacy and Electronic Communications (EC Directive) Regulations 2003 (SI 2003/2426) as amended.
- Market Research Society (MRS) Code of Conduct.
- ESOMAR (European Society for Opinion and Marketing Research) International Code of Marketing and Social Research Practice. These Terms and Conditions shall be governed by and be construed in accordance with Scots law. Both you and ScotPulse agree to the non-exclusive jurisdiction of the Scottish courts in respect of any dispute that may arise from or in connection with your membership of the ScotPulse panel and/or these Terms and Conditions.
